How do you decide what to do yourself, and what to leave to the professionals to do for you? It’s not easy to make the right decisions.

Starting a new business is expensive. If you opt to reduce the expense by setting up your own company, and buying your own domains, do you realise that you should first clear your chosen name? Have you really considered whether you are better off trading as self employed or through a company? You need to give yourself the best possible start by getting the basics right. Risk management is all too often pushed to one side in the face of all the other expenses young businesses face. Don’t be penny rich, pound crazy.

Why you need to know about trademarks before settling on a business name.

Surprisingly, the one preventative step that is an absolute must have - a clearance search to check that your chosen name is not someone else’s trademark is frequently overlooked when a business is set up or expands into new areas. This is a totally foolhardy risk to take, and the only explanation we have found for the widespread failure to have a trademark search before using a business name is that there is confusion about what it means to register your chosen name as a company or domain. While neither give you any protection whatsoever against competitors who have a registered trademark over the name, few people appreciate this fact. Currently only people who decide to trademark their name when they start up will find out if there is a problem with their name.
