It is possible to apply to revoke trademarks on various grounds:

  • Non use for a period of 5 years
  • The trade mark has become 'generic'
  • The trade mark is likely to mislead the public as to the nature, quality, or geographical origin of the goods or services on which it has been used

There is a form to submit with official fees of £200 to start revocation proceedings.

Generally, anyone who thinks that a trade mark or aspects of it should be cancelled or revoked may apply to have it cancelled.

Trade marks tend to be less vulnerable to attack once they have been on the register for 5 years.
