A great brand is born from a well implemented business idea, a unique name, and a logo that stands out from the crowd.

As intellectual property solicitors we are well placed to advise you on your options for protecting your logo. These are:

• Registering the logo both as a trademark and as a design.  There is a time limited window of opportunity to achieve a design registration.  If it is possible to obtain a design registration for your logo it's a valuable intellectual property to have.

• Registering just a design OR a trademark is the way to go if resources are only available for one.  A benefit of opting for design registration is the lower fees.  You could wait and see whether the logo works for your business long term before incurring the higher outlay of trademark registration.

• Copyright recordal of evidence such as through a statutory declaration is appropriate in any event.  Registering a US copyright can sometimes be a particularly effective form of international protection.

Trademarking a logo

There are 2 points to note about trademarking logos:

• Logos incorporating a word element or letters. It's necessary to establish whether you may secure exclusivity to these by searching the word to check that there is no conflict with someone else's trademark.
• Logos having an image element.  If your logo is an image, we need to establish whether any competitors are using a similar logo.
